What is forensic consulting?
Forensis consulting is the use of medical and scientific knowledge to provide an opinion — often related to the cause of a crime, or related to the detection of a crime.
Maahir Haque, MD — as one of the top-trained spine surgeons in the United States — regularly consults with plaintiff and defendant attorneys in Florida related to medical-legal issues in the field of spine care, including diagnosis of spine problems, nonsurgical treatment options and spine surgery.
In his role as an expert witness for both plaintiff and defendant attorneys in the Orlando, Florida area, he is often called upon to provide a spine surgeon opinion related to malpractice, misdiagnoses, traumas, missed injuries, personal injuries, and whiplash. These opinions can be used to produce legally admissible reports and testimonial evidence for use in a court.
As a nationally recognized specialist in the the most advanced treatment options for neck and back pain, including the most current minimally invasive treatment options for spine surgery, artificial disc and other implant technology, he can provide the most credible testimony related to spine care as well as spine physicians with less training and expertise.
What is the role of a consulting & non-testifying medical expert?
A medical expert can provide expertise to plaintiff and defendant attorneys in many capacities. Expertise can be provided in court during examination and cross-examination by both sides.
However, many times this medical expert capability is needed in the advance, planning stages of a case to enable an attorney to plan his or her legal strategy based on medical expert assessment of the case.
Dr. Maahir Haque is often called upon by attorneys in Florida during the discovery phase of a medical malpractice case related to spine care and the treatment of a back or neck problem.
Maahir Haque MD can help attorneys evaluate a case by providing opinions without testifying. This kind of expert opinion is protected from discovery, which is the pre-trial phase in a lawsuit when each party can obtain evidence from the opposing party by means of interrogations, request for documents, request for admissions or notes, and depositions and other discovery tactics.
What is the role of a consulting testifying medical expert?
Almost all medical malpractice cases will require some type of medical expert testimony. That’s because the facts involved in medical malpractice are too complex for non-doctors to judge if the patient's doctor should be held liable for the patient's injury. Typically, for example, in most states you must get a medical expert's opinion before a lawsuit can be started.
In medical negligence cases, such as medical malpractice lawsuits filed against physicians, the expert witness provides an opinion if the physician provided care that may have been below the community standard.
The spine medical expert will address if the doctor followed the standard protocol of care used by other spine surgeons. If so, did the doctor's failure to follow the standard of care injure the patient?
There have been instances where judges have dismissed the case because the technical information a jury must consider is too complicated to understand without an expert witness. A testifying medical expert can help the jury understand and consider the facts in the case.
Dr. Maahir Haque, as a frequent speaker at national meetings, is proficient in public speaking and has the ability to communicate complex medical and surgical concepts in a way the layperson and jury member can understand.
By contrast, some physicians are unable to communicate in a way that is understandable to the typical jury member, and a judge may often toss out the medical expert’s testimony accordingly as being too confusing rather than enlightening. If the physician is unable to communicate in an understandable way to the layperson, the testimony may unintentionally benefit the opposing side.
